This is an English translation of our German terms and conditions, provided for convenience. In case of doubt the German version is the binding one.
§ 1 Scope and contracting party
These terms apply to all contracts between MOVE:MENT Studios GmbH, Lübecker Straße 128, 22087 Hamburg (“MOVE:MENT”) and its customers concerning memberships, 10er-Karten, drop-in classes, course terms, room hire and corporate wellness allocations at the Hohenfelde, Wandsbek and Harburg studios.
§ 2 How a contract is formed
No contract is concluded through this website. The forms here are non-binding enquiries. A contract comes into being when you sign the membership application at the studio or pay at the desk. Corporate wellness allocations are concluded by written acceptance of our offer.
§ 3 Services
MOVE:MENT provides rooms, equipment and taught dance classes according to the timetable in force at the time. The timetable is planned term by term and may change at the end of a term. There is no entitlement to a particular teacher, a particular room or a particular class.
If a teacher is unavailable we try to arrange cover. Where that is not possible the class is cancelled. Cancellations are posted on the studio door and sent to members by email. A cancelled class never uses a 10er-Karte credit.
§ 4 Prices and payment
The prices displayed at the time the contract is concluded apply. Currently these are:
- All-studio flat: €89 per month
- Single studio: €69 per month
- 10er-Karte: €140, valid for twelve months
- Drop-in: €17 per class
- Corporate wellness: €690 per month for ten seats
With yearly billing, eleven monthly instalments are payable in advance in one sum; the twelfth month is not charged. All prices include statutory VAT. Membership fees are collected by SEPA direct debit on the third working day of each month. You bear the cost of any returned direct debit for which you are responsible.
Students, apprentices, people doing a Freiwilliges Soziales Jahr and holders of the Hamburg-Pass receive a reduction of €20 per month on production of proof. Proof must be presented again each year.
§ 5 Term, notice and pausing
Memberships run for an indefinite period and may be terminated by either party with one month’s notice to the end of a month. With yearly billing, termination is possible to the end of the year paid for. Notice must be given in text form; an email is sufficient. The right to terminate for good cause remains unaffected.
A membership may be paused free of charge for a total of eight weeks per calendar year, in blocks of at least two weeks. The pause must be notified in text form before it starts; it cannot be backdated. Both the fee and the service are suspended during a pause.
On the single-studio tariff, the home studio may be changed once per quarter. Visits to the other two studios cost €9 per class.
§ 6 Booking and cancelling classes
At least four places in every class are kept free for payment at the desk. Booked places may be cancelled free of charge up to two hours before the class starts. For later cancellations or non-attendance, a 10er-Karte credit is used; members incur no additional cost. Where someone repeatedly fails to attend without cancelling, we may restrict advance booking for that person.
§ 7 10er-Karte and drop-in
The 10er-Karte is valid for twelve months from the date of purchase and works at all three studios. It is transferable, and several credits may be used at once for people you bring with you. Unused credits are not refunded after expiry unless the reason for non-use is attributable to MOVE:MENT. A drop-in class is credited against the first monthly fee if a membership begins within fourteen days.
§ 8 House rules and participation
Only clean indoor shoes, dance shoes or socks may be worn in the studios; outdoor shoes stay in the changing room. Instructions from teachers and studio staff must be followed. Anyone who harasses, discriminates against or endangers other participants may be excluded from the class; in serious or repeated cases we may terminate the contract without notice.
Participation requires a level of health appropriate to the class. Participants are responsible for assessing their own fitness and should seek medical advice if in doubt. Please tell the teacher about any health limitation before the class.
§ 9 Children’s classes
The Street Kids class in Wandsbek is for children aged 8 to 12. Registration is made exclusively by a parent or guardian. Supervision outside class time is the responsibility of the parent or guardian; children must be brought and collected punctually. A term comprises twelve sessions at a price of €135.
§ 10 Liability
MOVE:MENT is liable without limitation for damage arising from injury to life, body or health, and for damage caused intentionally or by gross negligence. For slight negligence MOVE:MENT is liable only where a material contractual obligation is breached — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and in that case liability is limited to the foreseeable damage typical of this type of contract. Any further liability is excluded. The German Product Liability Act remains unaffected.
We accept no liability for valuables brought onto the premises. Lockers are available in Hohenfelde, Wandsbek and Harburg; the Cypher-Raum in Wandsbek has no lockers of its own. Lost property is kept for four weeks.
§ 11 Corporate wellness
A corporate wellness allocation comprises ten named seats and is valid at all three studios. Seats may be reassigned once per quarter. Invoicing is monthly to the company with payment due within fourteen days. On request, companies receive a quarterly usage report that names no individuals.
§ 12 Changes to these terms
We will notify changes to these terms or to prices in text form at least six weeks before they take effect. If you do not object before they take effect, the change is deemed accepted; we will draw your attention to that consequence separately in the notification. If you do object, you may terminate the contract with effect from the date the change takes effect.
§ 13 Final provisions
German law applies. Where the customer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is Hamburg. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
